IMPORTANT ANNOUNCEMENT

We are pleased to inform that Megaplast S.A. has obtained a new judgement in favor of its exclusive rights on the granted European patent EP 1 989 044 (“Patent”) which protects a perforated stretch film used for pallet wrapping.

In July 2024, the Patent Court of Madrid, Spain, condemned the company Ecoventi Sistemas S.L. for infringement of this patent for manufacturing a film that reproduces the claimed characteristics. This condemnation also extends to the distributor of the infringing products. Both Ecoventi Sistemas S.L. and its distributor are condemned to compensate Megaplast S.A for the damages caused since 2018. This judgment is subject to appeal by the defendants.

This is the second time that Ecoventi Sistemas S.L. has been convicted of infringing Megaplast's Patent, this time in relation to a new family of products replacing the one previously found to infringe the same Patent. In October 2016, the Patent Court of Barcelona, Spain, issued a decision in favor of Megaplast S.A. on patent infringement against Ecoventi Sistemas S.L., which was confirmed by the Court of Appeal of Barcelona in May 2018.

In said first court proceeding, Ecoventi Sistemas S.L. already paid damages for the period 2008-2013. Now Megaplast S.A. is seeking compensation for the damages suffered in the period 2014-2018, which Megaplast, S.A. values in an amount of no less than 8.909.812,38 Euros.

Megaplast enjoys the exclusive rights for packaging films as claimed in EP 1 989 044, whereas third parties are prohibited from producing, selling or offering for sale products making use of the subject matter of EP 1 989 044 without Megaplast’s consent.
