IMPORTANT ANNOUNCEMENT

Ecoventi Sistemas S.L. has repeatedly been convicted of infringing Megaplast's Patent in connection with different families of product:
 

• In October 2016, the Patent Court of Barcelona, Spain, issued a decision in favor of Megaplast S.A. on patent infringement against Ecoventi Sistemas S.L., which was confirmed by the Court of Appeal of Barcelona in May 2018 and by the Supreme Court in 2021. Megaplast is seeking compensation for the damages suffered in the period 2014-2018, which Megaplast, S.A. values in an amount of no less than 8.000.000 Euros.
• In July 2025, the Appeal Patent Court of Madrid, Spain, has confirmed a previous decision from the Patent Court of Madrid, of July 2024, which condemned the company Ecoventi Sistemas S.L. for infringement of Megaplast’s patent rights for manufacturing several films that reproduce the claimed characteristics. In accordance, Ecoventi Sistemas S.L. has also been condemned to compensate Megaplast S.A for the damages caused since 2018, which, according to preliminary calculations, Megaplast estimates to exceed 11.000.000 euros.

 
In October 2025, the Commercial Court of Barcelona, Spain, has ruled a decision declaring the non-infringement of Megaplast’s patent by a very specific product “OXI O” manufactured in the past by Ecoventi Sistemas S.L. for a single customer. MEGAPLAST decided not to appeal against this decision as it concerned exclusively a product which was not commercialized anymore. Hence, it does not declare that the other models appertaining to Ecoventi Sistemas S.L. do not infringe Megaplast’s patent, it just states that this particular product does not.

Indeed, MEGAPLAST enjoys the exclusive claimed by the patent EP 1 989 044, among others, for packaging films, whereas third parties are prohibited from producing, selling or offering products for sale making use of the patented subject matter without Megaplast’s consent.
